EULA - End User License Agreement

END-USER LICENSE AGREEMENT
ENERGY SAVER v3.2.9

By using this software you admit that you have read, understood and completely agreed to terms and conditions of this Agreement. If you don't agree to these terms and conditions, do not use this software and delete all copies of software you have. If terms and conditions of this software contravene legislation of your country, it is forbidden to use this software.
Pursuant to this Agreement, Individual Entrepreneur Svetlana Alexandrovna Fedorova (hereinafter referred to as the Rights holder) undertakes to grant the User (directly or through third parties) nonexclusive right to use the Software under the terms and conditions established in this Agreement (Contract) (an ordinary non-exclusive license).

Trial period of Software:
The Software is distributed according to the "try and buy" principle (shareware).
You may install, examine and use the Software within the trial period of 14 days upon its installation.
After the expiry of a trial period you must either register the Software or discontinue its operation.

The User shall buy ONE license for operation of Energy Saver on ONE mobile.

Procedure for transfer and cost of rights
Under this License Agreement, the User shall be granted by the Rights holder (directly or through authorized third parties) non-exclusive use of Software. The day of transfer of rights to the User shall be deemed to be the day of receipt by the Rights holder (or third party transferring the rights) of a license file for registration of Software. In consideration of the rights received the User shall pay a fixed fee which size is determined by terms and conditions of the Agreement entered into between the User and the party transferring the rights.
Information for registration shall be transferred to the User in the form of a personal license file which is generated on the basis of information regarding IMEI of mobile in which the Software shall be installed.

Confidentiality policy:
Upon receipt of a licensed file through Internet, as well as upon checking updates, the following technical specification of a mobile phone shall be transferred to the server of www.FedoroffSoft.com: IMEI, platform version, model, manufacture's code, current locale. No personal data shall be transferred.

Rules for operation of Software:
The User shall be entitled to operate the Software in the territory of the whole world in accordance with terms and conditions of this License Agreement (contract) upon compliance with the following rules:
It is forbidden:
1. to sell this software
2. to modify, reverse engineer, disassemble, decompile the Software;
3. to rent out, hire out or put out on loan, transfer a licensed software or part thereof differently than it is described in this license.
4. to remove any identification of a product, copyright notices, or any other notices or local constraints from this Software;
5. to copy documentation accompanying the Software.
6. to transfer a license file to third parties or in public access.
7. to operate the Software for the purpose of generation of malware data or code.
Any similar unauthorized operation shall result in immediate and automatic termination of this license and may entail a criminal and/or civil prosecution.

The User shall have the right:
To make copies of Software and license file provided that such copies are only for archival purposes and for replacement of a lawfully acquired distribution disk in the events when the original is lost, destroyed or became unusable. A copy specified in this paragraph cannot be used for any other purposes and must be destroyed, if operation of Software by the User stops being legal.
The Rights holder may provide the User with the following without any additional charges:
* Updates of minor software versions;
* Personal technical support in the form of answers to questions by email or using a specialized system of dealing with clients on the software site within one year upon transfer to him/her of a license file to the software;
* Support by providing public answers to typical questions;

Distribution of shareware - version:
You may have as many copies as you wish and distribute them to anybody provided that all files are not damaged. You must only distribute an original installation package (you must distribute an installation file, but not files created after installation has been completed). You may not sell this software. You may distribute Shareware-version of this Software on any CD-ROM, DVD-ROM without requiring permission from the Rights holder. Web-sites and any Internet-resources may distribute it as a file for downloads without requiring permission from the Rights holder.

Information regarding a copyright:
Individual Entrepreneur Svetlana Alexandrovna Fedorova is a holder of exclusive property rights and copyrights to the "Energy Saver" software for mobiles, documentation thereto in a hard-copy and soft-copy form and other parts. All the rights not expressly provided here are held by the Rights holder.

No warranties:
This Shareware-version is provided on an "as is" basis. The Rights-holder and/or his partners disclaim all warranties expressed or implied. The User must assume all the risk of operation of Shareware-version. The Rights holder and/or his partners do not bear any responsibility for damages direct or indirect caused by operation or impossibility to operate a Shareware-version, even if the Rights holder and/or his partners notified of the possibility of such damages.
Prior to purchase you must test the fitness and operational reliability of a product in your conditions.

Final provisions:
The period of validity of a registration code to the Program is not limited. The Rights holder has the right to change this License Agreement upon release of new Software versions.
